Law 9/2017, of 8 November, on Public Sector Contracts, which transposes into Spanish law European Parliament and Council Directives 2014/23/EU and 2014/24/EU, of 26 February 2014, applies not only to public administrations, but also to entities making up the so-called public sector, which are viewed as contracting authorities.


Since the said Law came into force, the Artium Foundation of Alava, as the contracting authority, has been required to award its non-harmonised contracts in accordance with Article 138(b) of this legal text. The regulation has adopted uniformity in the legal system, which means that the Law is binding on the application of the same tendering procedures as those used by Public Administrations in view of the possible existence of internal instructions arising from previous legislation on non-harmonised contracts.
